On Friday, October 31, 2003, I was driving east on Encinitas Blvd., in the city of Encinitas, CA. It was about 10:15am and the weather was dry and clear. I was in my 1997Chevrolet Suburban which had approximately 160,000 miles on it. I had just come to a stop at an intersection with a stoplight which was red. A Chevrolet Yukon was in front of me stopped at the signal also. The cross traffic (north-south) had just begun to go when all of a sudden it felt like a car or truck hit me from behind. My right foot was already on the brake because there is a slight incline at that intersection and I always have my foot on the brake when I come to a stop. After I felt the impact and hit the rear of the Yukon in front of me, I pushed down hard on the brake. The car paused momentarily and while I began to look in my rear view mirror to see what had happened, my car lurched forward again, while my foot was still on the brake, hitting the Yukon once again and knocking it into theintersection. The Yukon verred to the left, leaving room for my car to go by on the right. My car proceeded even though I was still trying to stop with the brake now to the floor(at this point I had a chance to actually look down and see that my foot was on the brake). It was only going about 20-25 miles per hour, but I was unable to stop it. I steered toward the curb on the right side of the street and when my right front tire went up on the curb, the car came to a stop at which time I put it in park, turned off the key and set the emergency brake. I ran to the Yukon to see if the driver was OK. He said he thought he was OK but he ended up going to the hospital in an ambulance just to get checked out. His car was driveable and he had called his partner who came down and drove it away. I didn’t want todrive mine anywhere after what had happened, so I called the Auto Club and had it towed to my Dealer, Weseloh Chevrolet in Carlsbad CA. Anyway, I am having my car checked out by the dealer and so far they have found no defect. From all the information I was able to find on theinternet, it appears that it is probably an intermittent problem that might never occur again. It also sounds like it has something to do with the cruise control, which I seldom use. I did check it’s position after I found out about it and discovered it was in the on position when the accident occurred. We had not, however, used it in the recent past (since August or September while on a trip to Colorado). I reported the incident to the dealer, GM Customer Service, the NHTSA, The Automobile Club of Southern California (Insurance) and now the Center forAuto Safety. I’m fortunate that no one was hurt. It’s pretty terrifying to think that something like that can happen and you have no control over it. I discovered from a paralegal who works with similar cases that mechanics and engineers recommend disconnecting the cruise control. I was wondering what to do with the car, but if disconnecting the cruise control will solve the problem, I will drive it. I would like to think that the manufacturer would step up to the plate and let the buyer know what could happen. Probably not good for business though! The adjuster for the Auto Club quoted approximately $1900 to repair my car.
